Businesses need to prepare for climate reporting in 2024

This article stresses that businesses need to begin work on their climate reporting.  However, it does not explain the urgency.

If you are a vendor, odds are, you will receive a Scope 3 letter in 2024.  This may be your initial notice from your client that you need to make a decision on if you want to retain that client.

Remember, if you are a vendor, you are categorized as Scope 3.  Larger companies will need to start reporting on their carbon emissions before smaller companies.  However, those larger companies will often need to include data from their Scope 3 vendors.  And, knowing that over the next few years their initial reporting will ultimately become audited reporting and later audited reporting with progress goals, most large companies know they will need to replace some vendors. 

Vendor replacement always takes time.  But in this case, they need to find vendors that are sustainable and have a carbon emissions plan.  That has them worried.  If they find a vendor that satisfies this, they will move fast. 

Therefore, expect a Scope 3 letter and an urgency from your larger clients.

Ignore the SEC’s ESG Agenda at your own risk

The author of this Forbes article cautions business leaders not to interpret the delay in the SECs’ climate-related disclosure standards as a sign that the SEC / United States has decided to stand down on ESG regulations.

In truth, the SEC has been aggressively using its Climate and ESG Enforcement Task Force, launched in 2021, to investigate and fine greenwashers.

Further, with the new COP28 agreement and many countries forcing climate-related disclosures, the US will need some form of national compliance program to ensure its business community can compete globally.

 

For non-public SMEs, why should you care? 

  • You should care because you are what is called a Scope 3 vendor, which means that as the larger companies are forced to report on emissions, they are going to need vendors that are sustainable and have carbon emissions programs in order for the larger company to provide the Scope 3 part of its submittal.

  • You can ignore becoming sustainable and having a carbon program and get replaced as a vendor, or you can be proactive and take market share from your competitors who ignore.

Demand for Carbon-Neutral SME Suppliers Jumps Dramatically

The impact of Scope 3 mandates are already being felt; even before the 2024 laws take effect.

Per this article, recent research shows a bold shift among SMEs, with 89% pursuing suppliers who have solid green credentials (ie, certified) and have a shared commitment to carbon neutrality.

This article offers six reasons why a law firm serving SMEs should develop a sustainability ‘strategy’.

First, let’s change ‘strategy’ to ‘program’.  You can strategize forever.  What you need is to actually execute a sustainability program for your company.  This ties to the 7th point, which we added, below.

COP28 Agreement Signals “Beginning of the End” of the Fossil Fuel Era

COP28 has ended with a demonstration of global solidarity.  Over 120 countries signed the final document which is discussed in this United Nations press release

 

The key language –

  • The global stocktake is considered the central outcome of COP28 – as it contains every element that was under negotiation and can now be used by countries to develop stronger climate action plans due by 2025.The stocktake recognizes the science that indicates global greenhouse gas emissions need to be cut 43% by 2030, compared to 2019 levels, to limit global warming to 1.5°C. But it notes Parties are off track when it comes to meeting their Paris Agreement goals.The stocktake calls on Parties to take actions towards achieving, at a global scale, a tripling of renewable energy capacity and doubling energy efficiency improvements by 2030. The list also includes accelerating efforts towards the phase-down of unabated coal power, phasing out inefficient fossil fuel subsidies, and other measures that drive the transition away from fossil fuels in energy systems, in a just, orderly and equitable manner, with developed countries continuing to take the lead.

 

What this means for your business –

  • Given that countries are tasked with developing stronger climate action plans by 2025….expect to see more governmental laws demanding proof of sustainability, carbon neutrality, carbon emission reductions and net zero attainment. This can be viewed as an opportunity or curse, depending on if you want to get ahead of it and take market share or delay, and lose market share.

 

  • Given that it was agreed that greenhouse gas emissions need to be cut by 43% in six year….expect dramatic demands by governments, investors, lenders and your clients for you to prove you are part of the solution. Again, this can be an opportunity or curse.

 

  • Given that energy efficiency needs to double by 2030….think of your energy demand needing to be cut in half by that time. How are you going to get there without help?
